Privacy Policy

This Privacy Policy explains how Nizpro Marine (“Nizpro”, “we”, “us”, “our”), collects, holds, uses, and discloses your personal information when you:

  • contact us, make an enquiry, or visit our website;
  • buy products or services from us;
  • have work performed on your engine or equipment; or
  • use the Nizpro Calibration & Diagnostics System (the “Platform”), including our desktop software and web portal.

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy sets out how we meet our obligations under that Act. A copy of the APPs is available from the Office of the Australian Information Commissioner at oaic.gov.au.

1. What is personal information

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable. It does not include information about a business itself.

2. The personal information we collect and hold

Enquiries, sales, and service

When you contact us, buy from us, or have work performed, we may collect:

  • Contact details: your name, email address, phone number, and postal or delivery address.
  • Enquiry and correspondence records: the content of messages you send us and our replies.
  • Transaction records: what you purchased, invoices, and payment status. Card payments are processed by our payment processor. We do not receive or store your full card number.
Platform accounts

When you create and use a Platform account, we collect and hold:

  • Identity and contact details: your first name, last name, and email address. Your email address is the permanent identifier for your account.
  • Authentication information: the fact that your email address has been verified, and account security credentials. Your password is set and held by our authentication provider; we never see or store your password.
  • Authorised-computer records: to control how many computers may run the desktop software under your account, we record a software-generated identifier for each computer you authorise, the computer’s hostname (as a label so you can recognise it), and when it was last used.
  • Activity and technical information: a log of significant actions taken on your account (such as sign-ins, flashes, and transfers), with the date and time, your IP address, and your browser or device information (user agent). We also record when you last logged in.
  • Account records: information about the ECUs, calibrations, credits, and devices associated with your account, and your account type.
  • Dealer details (dealers only): if you hold a dealer account, your business name and website.
Sensitive information

We do not collect sensitive information (such as health, racial, political, or biometric information), and we do not knowingly collect personal information from children.

3. How we collect your personal information

We collect most personal information directly from you, for example when you contact us through our website or by email, place an order, bring equipment to us for work, or register and use a Platform account.

Some information is generated automatically as you use the Platform, such as authorised-computer identifiers, activity-log entries, IP addresses, and device information.

In some cases we may receive your personal information from a third party. For example, a Nizpro dealer may create a Platform account on your behalf while performing work for you, entering your name and email. Where this happens, you are sent a link to confirm your email and set your own password. Where we receive your personal information from a third party in other circumstances, we will take reasonable steps to make you aware of it.

4. Why we collect, hold, use, and disclose your personal information

We use your personal information to:

  • respond to your enquiries and correspondence;
  • supply products and services, process payments, and keep business and tax records;
  • perform work on your engine or equipment and keep records of that work for service, warranty, audit, and security purposes;
  • create, verify, and manage your Platform account, and authenticate you when you sign in;
  • enable you to use the Platform and our software and hardware;
  • enforce the limit on the number of computers authorised under your account;
  • send you service and transactional messages, including notices about updates to calibration files for your equipment;
  • send you marketing communications, as described in Section 5; and
  • meet our legal obligations.

We may also use your personal information for a secondary purpose closely related to the purpose for which it was collected, where you would reasonably expect us to.

We do not sell your personal information.

5. Marketing

If you contact us through our website and agree to receive marketing communications, or contact us by email, we may add your email address to our mailing list and send you news, product information, and offers.

Every marketing email includes an unsubscribe link. You can also opt out at any time by emailing sales@nizpromarine.com.

We do not currently add Platform account details to our mailing list. If this changes, we will update this policy, and you will be able to unsubscribe at any time. Service and transactional messages about your account or equipment, such as calibration file update notices, are not marketing and are sent regardless of your mailing-list status.

6. Who we disclose your personal information to

We disclose personal information only where necessary to run our business and operate the Platform:

  • Service providers: providers who store or process information on our behalf under obligations to protect it, including our cloud hosting, authentication, accounting, and payment-processing providers.
  • Dealers: where a dealer performs work for you or manages equipment associated with your account, information relevant to that work.
  • Legal and safety: where we are required or authorised by law, or to protect our rights, property, or safety, or those of others.
  • With your consent: any other disclosure you agree to.

We do not otherwise disclose your personal information to third parties.

7. Overseas storage and access

Platform data is stored in an Australian data region.

Your information may be accessed by our personnel located in New Zealand in the course of operating, administering, and supporting our business and the Platform.

Where you sign in to your own account, you may access your own information from any location; this is your access to your own data, not a disclosure by us.

8. Cookies

Our Platform web portal uses cookies that are essential for you to sign in and use the service (for example, to keep you logged in during a session). We do not use analytics, advertising, or behavioural-tracking cookies on our website or the Platform.

9. How we hold and protect your personal information

We hold your personal information in secured cloud environments. We take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification, or disclosure, including restricting access to authorised personnel, using a managed authentication provider, and applying access controls.

No method of storage or transmission is completely secure, but we take reasonable steps to protect the information we hold.

10. How long we keep your personal information

  • Business records (including invoices and transaction records): kept for a minimum of 7 years.
  • Mailing list: kept until you unsubscribe.
  • Platform account profile (name and email): kept for as long as your account is active. If you ask us to delete your account, we will delete your profile information, subject to any records we are required or entitled to retain.
  • Platform activity logs (including IP address and device information): retained indefinitely for security, audit, and fraud-prevention purposes.
  • Authorised-computer records: retained as a historical record after a computer is de-registered.

Where we no longer need personal information for any purpose permitted under the Privacy Act, and are not required by law to keep it, we will take reasonable steps to destroy or de-identify it.

11. Keeping your information accurate

We take reasonable steps to make sure the personal information we hold is accurate, complete, and up to date. If you find that information we hold about you is inaccurate or out of date, please tell us so we can correct it.

12. Accessing and correcting your personal information

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, or misleading.

To make a request, email sales@nizpromarine.com. We will respond within a reasonable period. We may need to verify your identity before acting on a request.

There is normally no charge, though we may charge a reasonable amount for providing access in some circumstances, and we will tell you in advance if so.

You can update your Platform account name directly in the web portal. Your email address is your account identifier and cannot be changed; if you need a different address, contact us and we will move your account.

13. Anonymity

You may make general enquiries without identifying yourself. However, to supply products, perform work, or provide a Platform account, we need to identify you. The Platform is an account-based service that must identify you to authenticate you and record work performed on your equipment, so it cannot be used anonymously or under a pseudonym.

14. Data breaches

We comply with the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth). If a data breach involving your personal information is likely to result in serious harm, we will notify you and the OAIC as required by law.

15. Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, contact us at sales@nizpromarine.com so we can address it. We will acknowledge your complaint and respond within a reasonable period.

16. Changes to this policy

We may update this policy from time to time. The current version is always available on our website, and the “Last updated” date at the top shows when it last changed.
